Guard Rails and Motorcycle Accidents
Guard rails are a safety feature at certain locations along streets and highways. They can prevent vehicles from crossing into oncoming traffic and can prevent tragic falls downs sudden drop-offs alongside the road. Unfortunately, there is growing evidence to suggest that the currently utilized guard rail designs pose a disproportionate risk to the safety of motorcyclists.
If you have been injured in a motorcycle accident caused by a driver who forced you into the guardrail, it may be in your best interest to pursue financial compensation through a civil lawsuit. In his paper, “The Emerging Risk of Fatal Motorcycle Crashes with Guardrails”, Professor Hampton C. Gabler of Virginia Tech examined data gathered in the Fatality Analysis Reporting System (FARS), the National Automotive Sampling System (NASS), and the General Sampling System (GES) to determine how motorcyclists fared in collisions with guardrails.
Just a few of the alarming discoveries that he made are:
- Motorcycles at the time of the study (2005) only accounted for 1 out of 50 registered vehicles, but motorcyclists accounted for 21 out of 50 fatalities associated with guardrail collisions.
- The number of car occupant fatalities declined over the period from 2000-2005, but the number of motorcyclist fatalities increased at a greater rate.
- 1 out of every 10 motorcyclists who struck a guardrail perished, a rate of fatality more than 80 times as great as that of persons in cars or other automobiles.
The notion that a safety device can cause great harm is unsettling, and it warrants special consideration in the event of motorcycle accidents which involve contact with these barriers.
Because guardrails can be so dangerous for motorcyclists, it is important that negligent drivers do not compel them to make contact. If you have been hurt in a motorcycle accident contact the Wisconsin motorcycle accident lawyers of Habush Habush & Rottier S.C. ® at 800-242-2874.
